Am I old enough to have sex?

The law in Victoria says if you are:

under 12

  • no one can have sex with you or touch you sexually or perform a sexual act in front of you.

12 to 15

  • only a person who is within TWO calendar years of your age can have sex with you or touch you sexually. Even if you both want to do it, their age is the most important thing.
  • no one who is caring for you or supervising you, (like a teacher, youth worker, doctor, sports coach, foster carer) can have sex with you or touch you sexually, even if you agree.

16 or 17

  • no one who is caring for you or supervising you, (like a teacher, youth worker, doctor, sports coach, foster carer) can have sex with you or touch you sexually, even if you agree.

18 and over

  • if there is consent, you can legally have sexual contact with anyone over the age of 16 that is not a close family member or you are caring for or supervising.

Certain professions (doctors, teachers etc) have codes of conduct that do not allow any sexual contact with patients/students etc even if they are over 18
